1.3 CLP Power has absolute discretion to determine the eligibility of a customer to participate in this Scheme.
1.4 CLP Power is not obliged to enter into any correspondence with any party on any matter related to this Scheme.
1.5 CLP Power may disclose and/or publish the partial name of the customers and partial CA Number in accordance with the Personal Information Collection Statement annexed hereinafter in any mode and manner as CLP Power at its sole discretion deems appropriate for publicity purposes. CLP Power reserves the right to invite customers to attend event(s) for publicity and/ or promotion purposes under their consent.
1.6 The English version of these Terms and Conditions shall prevail in case of any discrepancy between the English and Chinese versions.
1.7 Regarding any dispute arising from Eco Rewards, the decision of CLP Power shall be final and binding.
1.8 CLP Power shall not be responsible for any matters or disputes relating to the offers provided by the respective merchants. The respective merchants are solely responsible for all warranties, obligations and liabilities in relation to such products or services.
1.9 If, for any reason, CLP Power is not capable of conducting this Scheme as planned, including due to infection by computer virus, bugs, tampering, unauthorised intervention, fraud, technical failure or any other causes beyond the control of CLP Power, which corrupt or affect the administration security, fairness or integrity or proper conduct of this Scheme, CLP Power reserves the right in its sole discretion to take any action that may be available and appropriate.
1.10 To the extent that any provision of these terms and conditions is unenforceable or is held invalid by any law, rule, order or regulation of any government, or by the final determination of any court of a competent jurisdiction, such invalidity shall not affect the enforceability of any other provisions not held to be invalid.
1.11 CLP Power has the absolute right to amend, delete or supplement any of these terms and conditions in its sole discretion, and to change, suspend or terminate this Schemeat any time without giving prior notice to the customers in its sole discretion.
1.12 These terms and conditions shall be governed by the laws of Hong Kong and customers irrevocably submit to the exclusive jurisdiction of the courts of Hong Kong.
1.13 To the extent permitted by law, CLP Power shall not be responsible for any loss, damages, or liability (whether direct, indirect or otherwise), including but not limited to any loss of income, profit or reputation, arising in any way out of: (1) any technical failure or malfunction or any other problem in any computer, internet network or system, including due to infection by computer virus, bugs, tampering, unauthorised intervention, fraud, technical failure or any other causes beyond the control of CLP Power, (2) any shortage or inadequacy of any third party-service, (3) any notice or correspondence which is misdirected, delayed, altered or lost in the information transmission or otherwise.
1.14 Customers understand and agree that (a) any material to be downloaded or otherwise obtained through the use of this Scheme is accessed at customers’ own discretion and risk, and customers will be solely responsible for any damage to customers’ computer system or loss of data that results from the download of any such material; (b) Any advice or information, whether oral or written, obtained by customers from the Smart Shopping website https://store.clp.com.hk/ or through or from the service shall not create a warranty unless otherwise state in the terms and conditions.
1.15 Customers agree to receive Email Energy Report for each billing cycle when they provide their email address to CLP Power. If customers do not want to receive Email Energy Report, they should advise CLP Power by contacting our Service Hotline at 2678 2678.
1.16 CLP Power may send direct marketing information to customers upon receipt of customers’ consent. If customers do not want to receive any direct marketing information, they should advise CLP Power by contacting our Data Protection Officer on 2678 2678 or emailing to [email protected]
2.1 CLP customers with residential tariff Customer Account number (CA). Customers can access to Eco Rewards via CLP Web (www.clp.com.hk) and App.
2.2 Participating accounts must maintain the electricity consumption under the same CA and electricity account holder.
2.3 The employees of CLP Power are not eligible for this Scheme.
2.4 CLP Power accepts no responsibility for any entries not received for any reason during the Registration Period. Entries will be deemed to be accepted at the time of receipt by CLP Power. No responsibility will be taken for lost, incomplete, late or misdirected entries. CLP Power is not responsible for technical difficulties with the entry mechanism and does not warrant that the entry mechanism will be available at all time.
3. Customers Obligation
3.1 All eligible customers must ensure that all information provided should be true, accurate, complete and update, and promptly keep the information true, accurate, complete and update without any fraud on submission of personal data, or false submission of personal data of others. Customers shall be responsible for any loss, damage or liability arising out of or in connection with any fraud on submission of personal data, or false submission of personal data of others, and indemnify and hold CLP Power and the relevant party harmless for any loss, damage, claim arising out of or in connection with any fraud on submission of personal data, or false submission of personal data of others.
4.1 If customers provide any information that is untrue, inaccurate or omitted, or CLP Power has reasonable grounds to suspect that such information is untrue, inaccurate or omitted, CLP Power has the absolute right to suspend or terminate the customers’ use of this Scheme and its related benefits, and the customers will not be entitled to all current or future use of this Scheme (or any portion thereof).
4.2 CLP Power may at its sole discretion to suspend or terminate this Scheme and related benefits to the customers if customers commit misconduct, fraud, misuses of this Scheme benefits and offers in any way with unacceptable content (including any content that incites hatred or discrimination, whether racial, social or political, or any unlawful, harmful, threating, abusive, harassing, tortuous, defamatory or otherwise objectionable content), or fail to comply with these terms and conditions.
4.3 CLP Power may terminate any customers’ participation and any use of this Scheme immediately without prior notice if it is of the reasonable opinion that the customers have already violated these Terms and Conditions.
4.4 CLP Power may, at its absolute discretion, terminate or suspend this service or its any part without prior notice. In the event that this service is terminated or suspended under this clause, CLP Power will terminate or delete all customers’ account under this Scheme and all related information immediately.
4.5 In the event that any termination or suspension made under this Clause, all Eco Points and related entitlements (both current and unused) will be cancelled without compensation.
5. Earning Eco Points
5.1 Customers can gain points through joining Energy Efficiency & Conservation (EE&C) programs such as Power Connect or participating other events in CLP Power. Customers may refer to Power Connect website (https://powerconnect.clp.com.hk/) fordetails.
5.2 CLP Power has the absolute right to change, update, and amend Eco Point earning mechanism without prior notice. CLP Power may timely review Eco Point earning mechanism.
5.3 No alteration, withdrawal or cancellation is allowed once a redemption transaction is confirmed.
5.4 In the event that the customer’s account or Eco Points is lost or stolen, CLP Power will not be responsible or liable for the loss of points or benefits.
5.5 Eco Points cannot be transferred or for sale or exchanged for cash, discount and /or in kind unless expressed in any specific redemption activity.
5.6 Any sale or barter of Eco Points or other correlated benefits is prohibited and will result in the forfeiture of all Eco Points and the termination of user right. The customers shall indemnify and hold CLP Power and the merchants harmless from any liability and claims resulting from selling or bartering of Eco Points or other programme benefits.
5.7 Customers who engage in fraudulent to obtain benefits or Eco Points are resulted to immediate cancellation or suspension of all related Eco Points or benefits without prior notice.
5.8 All Eco Points will be valid for 730 days, commencing from the date which the first Eco Point is received. All Eco Points should be used before the expiry date, otherwise they will be considered forfeit. No restoration or extensions will be allowed. After the expiry date, all points of each CA will resume to zero without further notification. Any new points earned subsequently would be given a new 730 days validity period. The validity period of Eco Points could be found on CLP Web (www.clp.com.hk) and App.
5.9 Eco Points cannot be carried over to the new CA when customers are move-out. All Eco Points in the move-out account will be lost and all unused redeemed rewards will also be forfeited.
5.10 CLP Power reserves the right in its sole discretion to change, suspend or terminate the Eco Points and the terms at any time without prior notice.
5.11 Customers may refer to “Earn Points Strategy” in Power Connect website (https://powerconnect.clp.com.hk/) for further detail.
6. Redeem Rewards
6.1 Rewards can be redeemed by Eco Points on a first come, first served basis.
6.2 Rewards available for redemption would be displayed at Smart Shopping website https://store.clp.com.hk/ or CLP Web (www.clp.com.hk) and App.
6.3 Each coupon is subject to its respective terms and conditions. CLP Power will not re-issue or replace an expired coupon.
6.4 Once a redemption transaction is confirmed, Eco Points will be deducted from a customers’ account, no alteration or cancellation is allowed.
6.5 If the redeeming quantity exceeded the stock quantity, such transaction would not be allowed.
6.6 Rewards will be delivered to customers by either of the following method:
By Post - Rewards will be mailed to customers’ correspondence address within 15 working days after receiving customers’ request to redeem.
Electronic – E-coupons will be stored in respective Eco Rewards account. Customers can present the E-coupon in CLP Mobile App to claim the reward items at designated collection points.
6.7 If customers lose their coupon, CLP Power will not be responsible for any obligation, claim of the coupons, payment or compensation. No return or restoration of Eco Points used for redeeming the coupons is allowed.
6.8 If customers fail to fulfil the eligible requirements, CLP Power will not be responsible for any obligation, claim, payment or compensation arising out of or resulting from the disqualification or forfeiture. No return or restoration of Eco Points used for redeeming the coupon is allowed.
6.9 Rewards cannot be changed, refunded, resold, and/or exchanged for cash. No refund, replacement and compensation will be allowed for any unused service and/or entitlement and/or loss or damage of product.
6.10 CLP Power reserves the right to change, suspend or terminate any redemption and its mechanism and terms at its sole discretion at any time without prior notice.
6.11 CLP Power is not supplier of any products or services redeemable under the Eco Rewards. The respective suppliers are solely responsible for all obligations and liabilities in relation to the relevant products or services.
6.12 CLP Power is not responsible for any lost, damaged or stolen products, vouchers, certificates or coupons redeemed or exchanged by customers under the Eco Rewards.
6.13 To the extent permitted by law, CLP Power accepts no responsibility for, nor does CLP Power guarantees defect-free, complete, accurate, or timely of any product and services. Customers are at their sole discretion to use or try the products and associated services at their own risk for any damage and loss arising out of or resulting from usage or trial of the product at any time or under any circumstances. CLP Power takes no liability for any defect of deficiency in any such products and services.
6.14 Redemption of goods, services, vouchers, coupons or other benefits at a participating merchant is subject to the merchant's policy and the terms and conditions specified by the merchant.
