1. Definitions
“CLP” and “we” mean CLP Power Hong Kong Limited.
“EV” means a vehicle that stores electrical energy from an external source and driven by electric motor.
“EVT” means the CLP’s Electric Vehicle Tariff.
“EVRTOUT” means the CLP’s Electric Vehicle Residential Time of Use Tariff.
“Private Use” means it is solely for the own use of the parking space owner or tenant and not for any commercial purposes.
“RT” means the CLP’s Residential Tariff.
“Smart Meter” means a measuring instrument and associated equipment belonging to CLP designed to measure, register, indicate and transmit the integral value of electricity consumption or demand with respect to time through a wireless network.
2. Application and eligibility for EVRTOUT
2.1 We will conduct an assessment of your eligibility for EVRTOUT when we receive from you a duly completed EVRTOUT application form. The eligibility conditions are set out in section 2.2 below. Once we have confirmed your eligibility for EVRTOUT, we will create a new CLP’s EVRTOUT account or change your existing CLP’s EVT account to a CLP’s EVRTOUT account (as applicable) for you. If you are not eligible for EVRTOUT, we will create for you a CLP’s EVT account. Your CLP’s EVT or EVRTOUT account will be separate from your CLP’s RT account. Each of the accounts will have its own meter for the purpose of electricity consumption measurement.
2.2 You are only eligible for EVRTOUT if all of the following conditions are satisfied:
(a) your EV charging facility is installed within a residential parking lot;
(b) your EV charging facility is solely for Private Use;
(c) EV subscription service is not provided by any third parties through your EV charging facility;
(d) the wireless telecommunication network signal at the location of the Smart Meters and associated collectors is determined by CLP to be sufficiently strong for the purposes of EVRTOUT; and
(e) you agree to ensure your Smart Meter is turned on at all times to support accurate measurement of electricity consumption and remote consumption data retrieval.
3. Change of tariff
3.1 You may make an application to us to change your tariff type back to EVT (or from EVT to EVRTOUT) at any time. We will notify you on the outcome of your application within 30 days after receipt of your application. If your application is approved, the commencement date of the new tariff type will normally be the day after the next meter reading date.
3.2 CLP reserves the right to change your tariff type EVRTOUT to EVT without notice if:
(a) you cease to satisfy any of the conditions set out in section 2.2;
(b) we are not able to receive a sufficient level of consumption data considered by us necessary for EVRTOUT to apply;
(c) the Smart Meter is not turned on at all times; or
(d) you fail to ensure we have safe and unrestricted access to CLP’s equipment for electricity consumption measurement or any other purpose upon request by us with advance notice to you.
4. Settlement and adjustment of charges
4.1 Your electricity bill will be calculated based on the electricity consumption shown on your electricity bill. Any electricity consumption data provided through other means is for your reference only.
4.2 You acknowledge and understand that the timeliness and completeness of consumption data retrieval may be affected by reasons beyond CLP’s reasonable control including but not limited to the status of the main switch before the Smart Meter and consumption data transmission quality. You may be billed by an estimation of hourly electricity consumption based upon your latest usage or such other basis as we consider appropriate.
4.3 If you would like to dispute the estimated hourly electricity consumption, you may submit a written application to us requesting for a review. You shall provide supporting evidence such as electricity consumption history to substantiate your claim. We may, on the basis of our records, available technical evidence, your electricity consumption history and other relevant circumstances make retrospective adjustments to the amounts shown in our records as due from you in respect of electricity consumption to such extent and for such period as may be reasonably determined by us to be necessary.
5. Billing arrangement
5.1 We will present your bill through the e-mail address you provided to us. In addition, you may also access your bill through your CLP online account.
5.2 Group billing arrangement is not available for CLP’s EVRTOUT accounts. All CLP’s EVRTOUT accounts will be excluded from any group billing arrangement that is already in place at the time of approval.
6. General
We may revise these terms and conditions from time to time. These terms and conditions shall be read together with the Supply Rules published and amended by CLP from time to time. In the event of any conflict or inconsistency between the Supply Rules and these terms and conditions, these terms and conditions shall prevail.
