        Terms and Conditions

        By applying for the supply or the transfer of supply of electricity or by obtaining or using electricity from the CLP Power Hong Kong Limited ('CLP Power'), the Applicant agrees to be bound and to abide by the Supply Rules published by CLP Power from time to time. The Applicant agrees to the Supply Rules of CLP Power and understands that these rules and CLP Personal Information Collection Statement and other terms and conditions concerning supply as prescribed by CLP Power (as revised from time to time). This is to confirm that the undersigned is the Applicant (or the Applicant's authorised representative/agent) and that details given in this form are true and accurate and the Applicant shall not hold CLP Power responsible for any fraudulent acts on his/her part. The Applicant (or the Applicant's representative/agent) shall compensate CLP Power for all damage, injury or losses of whatever nature suffered by CLP Power as a result of any fraudulent acts on his/her part or on the part of the applicant and the Applicant (or the Applicant's representative/agent) shall indemnify and keep indemnified CLP Power against all actions, claims, costs and demands of whatsoever nature brought or made against CLP Power directly or indirectly out of or in connection with such fraudulent acts.

        1.  Definitions

        CLP and “we” mean CLP Power Hong Kong Limited.

        EV” means an electric vehicle that stores electrical energy from batteries and driven by electric motor.

        EVT” means the CLP’s Electric Vehicle Tariff.  

        EVRTOU” means the CLP’s Electric Vehicle Residential Time of Use Tariff.

        Private Use” means it is solely for the own use of the parking space owner or tenant and not for any commercial purposes.  

        RT” means the CLP’s Residential Tariff.

        Smart Meter” means a measuring instrument and associated equipment belonging to CLP designed to measure, register, indicate and transmit the integral value of electricity consumption or demand with respect to time through a wireless network.

         

        2.  Application and eligibility for EVRTOU

        2.1   We will conduct an assessment of your eligibility for EVRTOU when we receive from you a duly completed EVRTOU application form. The eligibility conditions are set out in section 2.2 below. Once we have confirmed your eligibility for EVRTOU, we will change your existing CLP’s EVT account to a CLP’s EVRTOU account for you. Your CLP’s EVT or EVRTOU account will be separate from your CLP’s RT account. Each of the accounts will have its own meter for the purpose of electricity consumption measurement.

        2.2   You are only eligible for EVRTOU if all of the following conditions are satisfied:

        (a)   you have an existing eMobility electricity account with meter installed for your EV charging facility;

        (b)   your EV charging facility is installed within a residential parking lot;

        (c)    your EV charging facility is solely for Private Use;

        (d)   the wireless telecommunication network signal at the location of the Smart Meters and associated collectors is determined by CLP to be sufficiently strong for the purposes of EVRTOU; and

        (e)   you agree to ensure your Smart Meter is turned on at all times to support accurate measurement of electricity consumption and remote consumption data retrieval.  

         

        3.  Change of tariff

        3.1   You may make an application to us to change your tariff type back to EVT (or from EVT to EVRTOU) at any time. We will notify you on the outcome of your application within 30 days after receipt of your application. If your application is approved, the commencement date of the new tariff type will normally be the day after the next meter reading date (i.e. the first day of next billing cycle). Your application will be refused if you have within 12 months prior to such application been so supplied and has at its own request ceased to be so supplied under the same tariff type.  

        3.2   CLP reserves the right to change your tariff type EVRTOU to EVT without notice if:

        (a)   you cease to satisfy any of the conditions set out in section 2.2;

        (b)   we are not able to receive a sufficient level of consumption data considered by us necessary for EVRTOU to apply;

        (c)   the Smart Meter is not turned on at all times; or

        (d)   you fail to ensure we have safe and unrestricted access to CLP’s equipment for electricity consumption measurement or any other purpose upon request by us with advance notice to you. 

         

        4.   Settlement and adjustment of charges

        4.1   Your electricity bill will be calculated based on the electricity consumption shown on your electricity bill.  Any electricity consumption data provided through other means is for your reference only.  

        4.2   You acknowledge and understand that the timeliness and completeness of consumption data retrieval may be affected by reasons beyond CLP’s reasonable control including but not limited to the status of the main switch before the Smart Meter and consumption data transmission quality.  You may be billed by an estimation of hourly electricity consumption based upon your latest usage or such other basis as we consider appropriate.

         

        5.  Billing arrangement

        5.1   We will present your bill through the e-mail address you provided to us.  In addition, you may also access your bill through your CLP online account.

        5.2   Group billing arrangement is not available for CLP’s EVRTOU accounts.  All CLP’s EVRTOU accounts will be excluded from any group billing arrangement that is already in place at the time of approval. 

         

        6.  General

        6.1  We may revise these terms and conditions from time to time.  These terms and conditions shall be read together with the Supply Rules published and amended by CLP from time to time.  In the event of any conflict or inconsistency between the Supply Rules and these terms and conditions, these terms and conditions shall prevail.
